I. General Terms and Conditions
Article 1: Basic Provisions
1.1 These Terms and Conditions ("Terms") govern all contracts concluded between you ("Customer" or "you") and IMOS Print UG ("we", "us" or "the Company") via the website copyshop-versand.de.
1.2 By placing an order through our website, you agree to be bound by these Terms. These Terms apply in addition to, and without prejudice to, your rights under UAE Federal Law No. 15 of 2020 (Consumer Protection Law) and other applicable UAE laws.
1.3 Customer within these Terms means any natural or legal person who purchases goods or services from us for personal, family, household or business purposes.
Article 2: Contract Formation and Electronic Transactions
2.1 Subject of Contract: The contract relates to the sale and, where applicable, customized production of printing and copying services and related goods.
2.2 Offer: By displaying products on our website, we make a binding offer to sell those products under the conditions specified in the product description.
2.3 Electronic Transactions: In accordance with UAE Federal Decree-Law No. 50 of 2022 on Electronic Transactions and Trust Services:
a) Electronic contracts concluded through our website are legally valid and enforceable;
b) Your electronic acceptance constitutes a legally binding signature;
c) By clicking "Place Order" or similar button, you acknowledge and accept these Terms;
d) We will provide electronic confirmation of your order via email.
2.4 Order Process:
a) Add desired products to your shopping cart
b) Review your order and proceed to checkout
c) Enter your delivery and payment information
d) Review the complete order summary including all costs
e) Click "Place Order" to submit your binding order
f) You will receive an order confirmation by email
2.5 Contract Conclusion: The contract is concluded when you click "Place Order" and we send you an order confirmation email. The contract language is English.
2.6 You must ensure that the email address you provide is correct and that our emails are not blocked by spam filters.
Article 3: Custom-Made and Personalized Goods
3.1 File Submission: For customized products, you shall provide us with the required information, texts, images or files via our online ordering system or by email immediately after contract conclusion. You must comply with our specifications regarding file formats.
3.2 Intellectual Property Warranty: You warrant that:
a) You own all intellectual property rights in the materials you submit, or have obtained necessary permissions;
b) The submitted materials do not infringe any third party rights including copyrights, trademarks, or personality rights;
c) The materials do not violate UAE laws or Islamic principles;
d) You will indemnify us against any claims by third parties arising from your submitted materials, to the extent permitted by UAE law.
3.3 Content Review: We do not review submitted content for accuracy or legality. You are solely responsible for the content you provide.
3.4 Copyright in Our Work: Where we create original designs, texts, images or graphics for you:
a) The copyright in these works remains with us;
b) We grant you a non-exclusive license to use the works for the intended purpose;
c) You may not transfer, sublicense or commercially exploit these works without our written consent;
d) The license is subject to full payment of the purchase price.
Article 4: Prices, Payment and VAT
4.1 Prices: All prices stated on our website are in AED (United Arab Emirates Dirham) and are inclusive of 5% Value Added Tax (VAT) as required by UAE Federal Decree-Law No. 8 of 2017 on Value Added Tax.
4.2 Total Price: The total price includes:
a) Product price
b) VAT (5%)
c) Shipping costs (shown separately during checkout)
4.3 Payment Methods: Available payment methods are displayed on our website. Unless otherwise stated, payment is due immediately upon contract conclusion.
4.4 Currency: All transactions are conducted in AED. If you pay in another currency, the exchange rate applied will be that of your payment provider.
Article 5: Delivery
5.1 Delivery Terms: Delivery conditions, estimated delivery times and any delivery restrictions are shown on our website or in the product description.
5.2 Delivery Address: Delivery will be made to the address you specify during the order process within the UAE.
5.3 Delivery Delays: Please note that delivery times may be extended during:
a) Holy Month of Ramadan
b) Eid Al-Fitr and Eid Al-Adha holidays
c) UAE National Day
d) Other public holidays
We will inform you of any significant delays.
5.4 Risk Transfer: The risk of loss or damage passes to you upon delivery of the goods.
Article 6: Your Rights - Consumer Protection
In accordance with UAE Federal Law No. 15 of 2020 (Consumer Protection Law)
6.1 Right to Information: You have the right to receive clear, accurate and complete information about products before purchase, including:
a) Product characteristics and specifications
b) Total price including all costs
c) Delivery terms
d) After-sales services and warranty
e) Return and refund policy
6.2 Right to Return/Exchange - Standard Goods:
For standard, non-customized goods, you may return the goods within 14 days of receipt if:
a) The goods are defective;
b) The goods do not match the description provided;
c) The goods are damaged during shipping;
d) The goods are not suitable for their normal purpose.
Goods must be returned in their original condition, packaging and with all accessories. This webshop offers exclusively customized and personalized products. Therefore, the right of return/exchange for standard goods does not apply. However, please contact our customer service for assistance in case of issues with your order.
6.3 Exclusion from Return Right - Customized Goods:
IMPORTANT: Customized, personalized or made-to-order goods cannot be returned or exchanged unless they are:
a) Defective or damaged;
b) Significantly different from your specifications;
c) Not suitable for their intended purpose despite being made to your specifications.
By ordering customized goods, you acknowledge and accept that the return right is limited to these circumstances.
6.4 Refund or Remedy:
If goods are defective or non-conforming, you are entitled to:
a) Replacement of the goods with conforming goods;
b) Repair of the goods (where possible);
c) Full refund of the purchase price;
d) Partial refund (price reduction) if you wish to keep the goods.
We will process refunds within 14 days of receiving the returned goods, using the same payment method you used for purchase.
6.5 How to Return:
To initiate a return:
1. Contact us at support@imos-print.de within the applicable return period
2. Provide your order number and reason for return
3. We will provide return instructions
4. Ship the goods to the address we provide
Return shipping costs:
- For defective/non-conforming goods: we pay return shipping
- For other eligible returns: you pay return shipping
6.6 Warranty:
All goods carry the warranty rights provided under UAE law. Any manufacturer's warranty is in addition to your statutory rights.
Article 7: Limitation of Liability
7.1 We are fully liable for damages resulting from:
a) Death, personal injury or damage to health;
b) Intentional misconduct or gross negligence;
c) Breach of fundamental contractual obligations;
d) Fraudulent misrepresentation.
7.2 For other damages caused by slight negligence, our liability is limited to the contract value and foreseeable damages typical for this type of contract.
7.3 We do not guarantee that our website will be available without interruption or error-free. We are not liable for:
a) Temporary unavailability of the website;
b) Errors in data transmission over the internet;
c) Actions of third-party payment providers.
7.4 Nothing in these Terms shall exclude or limit our liability to the extent it cannot be excluded or limited under UAE law.
Article 8: Governing Law and Jurisdiction
8.1 Governing Law: These Terms and all contracts concluded under them shall be governed by and construed in accordance with the laws of the United Arab Emirates, including:
- Federal Law No. 5 of 1985 (Civil Transactions Law)
- Federal Law No. 15 of 2020 (Consumer Protection Law)
- Federal Decree-Law No. 50 of 2022 (E-Commerce Law)
- Federal Decree-Law No. 8 of 2017 (VAT Law)
To the extent applicable, the principles of Islamic Sharia as applied in the UAE shall prevail in case of conflict.
8.2 Jurisdiction: For all disputes arising out of or in connection with these Terms or any contract concluded between you and us:
a) The courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction;
b) Consumer rights under UAE Consumer Protection Law remain unaffected;
c) You may also bring proceedings in the courts of your place of residence within the UAE if those courts have jurisdiction under UAE law.
8.3 Dispute Resolution: Before initiating court proceedings, we encourage you to contact our customer service to resolve any disputes amicably. UAE law provides for alternative dispute resolution mechanisms including mediation and arbitration.
8.4 Language: These Terms are provided in English. In case of any dispute regarding interpretation, the English version shall prevail. However, if UAE law requires an Arabic version, an Arabic translation will be provided upon request, and the Arabic version shall prevail in case of conflict.
